Hard Dig Contract Summary

Proposal pricing assumes normal soil conditions. Any excavation requiring rock breaking, specialized equipment, or additional labor due to caliche, bedrock, or other unforeseen hard dig conditions will be billed as an extra at time and material billed directly to the client from the excavation company. If access issues during pool excavation or construction require equipment other than what is specified in the contract, all additional work will be billed at time-and-material rates through an approved change order. Hard Dig Conditions.

1. Definition of Hard Dig:

For the purposes of this contract, “hard dig” refers to subsurface conditions that are substantially more difficult to excavate than typical soil, including but not limited to:

Caliche, bedrock, boulders, or compacted materials requiring mechanical breaking or specialized equipment.

Man-made debris or obstructions not identified in the plans or disclosed prior to excavation.

Groundwater, excessive moisture, or soil instability that inhibits normal excavation methods.

2. Exclusions from Base Bid:

The base contract price includes excavation under normal soil conditions only. The following are specifically excluded unless otherwise noted in writing:

Jackhammering, rock saw, or hydraulic breaker use.

Hauling or disposal of excessive rock materials.

Extended labor or equipment time due to hard dig conditions.

3. Notification and Verification:

If hard dig conditions are encountered:

The Contractor shall immediately notify the Owner or Owner’s Representative before proceeding further.

The condition shall be inspected and verified jointly.

Work shall be paused in the affected area.

4. Direct Payment to Sub Contractor:

Once verified, any additional costs or schedule impacts associated with hard dig work shall be handled via direct payment to the Sub Contractor:

Actual time and materials, or

A mutually agreed lump sum adjustment.

5. Owner Responsibility:

Unless otherwise specified, the Owner is responsible for any additional cost or time extensions resulting from verified hard dig conditions not reasonably foreseeable prior to excavation.

6. No Warranty of Subsurface Conditions:

Contractor makes no warranty, express or implied, as to the nature or condition of subsurface materials. Any information provided by the Owner or third parties (e.g., soil reports) is for reference only and not guaranteed.

REGARDING LANDSCAPE

Industry-standard landscape contracts assume normal soil composition and standard working conditions.  

Should excavation or construction work be delayed, complicated, or made more costly due to unforeseen site conditions—including, but not limited to, caliche, bedrock, excessive rock, buried debris, underground utilities or obstructions, hard-dig soil, or other conditions not visible or reasonably anticipated prior to commencement—any extra labor, equipment, or specialized excavation (including rock breaking or hard-dig equipment) will be billed as an extra on a time-and-materials basis and documented by Change Order for approval prior to proceeding.
